1. WHAT IS THIS POLICY AND WHO DOES IT APPLY TO?

Randall J Coaching (the “Company” or “We” or “we” or “us” or “our”) is committed to respecting the privacy of all individuals, including our current and prospective coaches, clients, and visitors to our website. In this Privacy Policy (“Privacy Policy”) we will lay out how we process personal information, including on our website available at https://randalljcoaching.com and any other current or future online or offline offerings made by us which link to, or are otherwise subject to, this Privacy Policy (collectively, the “Services”). We have laid out this Privacy Policy so that you can find answers to questions you have about privacy, including:

  • The type of personal information that we collect from coaches, clients, website visitors and others.

  • The purposes for collecting that information.

  • How we disclose that information to others.

2. WHAT HAPPENS IF THIS POLICY IS UPDATED?

We may update this Privacy Policy periodically. If we do, we’ll let you know by posting the updated Privacy Policy on our website, and we also may notify you through a message when you log in or an email, particularly if the update results in a material change to the Privacy Policy. Whenever we update the policy, we’ll change the date at the top of the page where it says “Last Updated” as well, so you know that changes were made.

3. WHAT PERSONAL INFORMATION DO WE COLLECT?

  • Account Information: Information in connection with the creation or administration of your account, either as a coach or a client, such as your name, email address, phone number, your location and other information you store with your account.

  • Payment: Information and details associated with your purchases, including payment information from clients and account information in order to remit payment to individual coaches (this may include additional information we need in order to produce the appropriate tax documents). Any payments made are processed by third-party payment processors.

  • Your Communications with Us: Information that you may send to us such as when you contact us for questions, feedback or support.

  • Coaching-Related Communication: Information you communicate as part of consuming or providing coaching, such as through email, SMS, the messaging feature, digital tools and applications, session recordings (only with your explicit consent), and text based transcripts.

  • Assessments and Surveys: You may complete an assessment related to coaching. We may also ask you to participate in surveys.

  • Reviews or feedback about the Services: Information that you share about your experience using the Services.

  • Coach Profiles: For coaches, we may collect information in your profile that is required by clients to select a coach such as a bio, education, relevant experience, ratings and reviews. This information may be displayed on your public coaching profile and will be considered ‘public’.

  • Device Information: Information about your device, such as your Internet protocol (IP) address, user settings, cookie identifiers, other unique identifiers, browser or device information, Internet service provider, and location information (including, as applicable, approximate location derived from IP address and approximate geo-location information).

  • Usage Information: Information about your use of the Services, such as the pages that you visit, items that you search for, the types of content you interact with, information about the links you click, the frequency and duration of your activities, and other information about how you use the Services.

4. HOW DO WE USE PERSONAL INFORMATION?

  • To provide the Services, such as managing your client or coach information, providing access to certain areas, functionalities, and features of the Services, facilitating coaching communications, processing your financial information and other payment methods for products and services purchased by clients, remitting payment to coaches, and processing applications if you apply to become a coach.

  • For analytics and product development, such as understanding how you engage with different areas of our platform, collecting and analyzing reviews or feedback about our product, developing new products and service offerings or improving existing ones.

  • To improve the Services and develop new Services, such as ensuring internal quality control, enhancing client and coach safety, and if you (the client) opt in, optimizing AI models that power existing and new coaching tools for both clients and coaches. To protect your privacy, we take steps to de-identify and aggregate data we use to optimize AI models.

  • To communicate with you, such as sending you notifications or updates about your account, and responding to you when you ask for support.

  • For security, compliance and other administrative purposes, such as network and information security, fraud prevention, detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, prosecuting those responsible for that activity, authenticating and verifying individual identities (including requests to exercise your rights under this Privacy Policy), debugging to identify and repair errors with the Services, auditing relating to interactions, transactions, and other compliance activities, enforcing our agreements and policies, and carrying out activities that are required to comply with our legal obligations.

  • To create de-identified and/or aggregated information. If we create or receive deidentified information, we will not attempt to reidentify such information, unless required to comply with, applicable laws.

  • For marketing purposes, such as to provide you with marketing and other content. We may provide you with these materials as permitted by applicable law. Some of our marketing activities may be considered “targeted advertising” if you opt-in to such activities. See section ‘HOW DO WE DISCLOSE PERSONAL INFORMATION?' > 'Advertising Partners’ for more information. Click on ‘Cookie Settings’ in our footer to see our Cookie Notice and disable advertising cookies. Note that no information provided by clients during coaching sessions or in messages to coaches will ever be used for marketing purposes.

  • With your consent or direction, we may use personal information for other purposes that are clearly disclosed to you at the time you provide personal information, with your consent, or as otherwise directed by you.

  • For automated decision making, which may include profiling. If you have questions about our automated decision making, you may contact us as set forth in “Contact Us” below.

5. HOW DO WE DISCLOSE PERSONAL INFORMATION?

A. Disclosures to Provide the Services We may disclose the personal information we collect to the categories of third parties described below.

  • Service Providers: Third-party service providers that assist us with the provision of the Services may have limited access to your personal information. This may include, but is not limited to, service providers that provide us with hosting, payment processing, security, customer service, analytics, marketing services, IT support, messaging, video communication and related services. We take steps to share only the minimum amount of data necessary with service providers to enable specific functionalities. Note that we may utilize third-party service providers to send you email or SMS notifications. We do not allow these third-parties to use your email, phone number, content of the emails or SMS for their direct marketing/promotional purposes.

  • Google reCAPTCHA: We use a captcha service called reCAPTCHA operated by Google to ensure you are not a bot and to detect spam. The reCAPTCHA service may collect information from you and from your device for security purposes. The information gathered by reCAPTCHA is processed by Google in accordance with their Privacy Policy.

  • Coaches: As a client, once we pair you with a coach, that coach may access information that is relevant for them to provide services such as your profile information, messages and other communication between you and the coach, coaching related assessments, etc.

  • Other Users You Share or Interact With: We may allow you to communicate with other users and share personal information with other users of the platform through specific community-based features.

  • Review Platforms: Third party platforms that collect and facilitate reviews or feedback about your experience using Services. These platforms may invite you to share your review or feedback directly with them.

  • Advertising Partners: If you opt in, we may share your personal information with third-party advertising partners, excluding any information that you share during coaching sessions, or private messages with your coach. If you opt in, these third-party advertising partners may use Technologies on our Services to collect information regarding your activities and your device (e.g., your IP address, cookie identifiers, page(s) visited, location, time of day). These advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit digital properties within their networks. This practice is commonly referred to as “interest-based advertising”, “personalized advertising”, or “targeted advertising”.

Some of the advertising technologies we may use include:

B. Disclosures to Protect Us or Others

We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.

C. Disclosure in the Event of Merger, Sale, or Other Asset Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, purchase or sale of assets, transition of service to another provider, or other similar corporate transaction, your personal information may be disclosed, sold, or transferred as part of such a transaction.

D. Disclosure with Your Explicit Consent

For a new purpose not listed here, we may disclose your personal information after explaining to you the reason for sharing information and getting your explicit consent.

6. USE OF COOKIES

  • Cookies. Cookies are small text files stored in device browsers.

  • Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded in the Services that collects personal information about use of or engagement with the Services. The use of a pixel tag allows us to record, for example, that a user has visited, a particular web page or clicked on a particular advertisement. We may also include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded.

Cookies, Pixel Tags/Web Beacons and other similar technologies (“Technologies”) may be used to automatically collect, process and disclose personal information through your use of the Services.

7. WHAT PRIVACY CHOICES AND RIGHTS DO I HAVE?

Your Privacy Choices. The privacy choices you may have about your personal information are described below.

  • Email Communications. If you receive an unwanted email from us, you can use the unsubscribe functionality found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails. We may also send you certain non-promotional communications regarding us and the Services, and you will not be able to opt out of those communications (e.g., communications regarding the Services or updates to this Privacy Policy).

  • Text Messages. If you receive an unwanted text message from us, you may opt out of receiving future text messages from us by following the instructions in the text message you have received from us or by otherwise contacting us as set forth in “Contact Us” below.

  • Transcripts and session recordings. All coaching sessions are automatically transcribed and summarized. Session audio/video recording is optional and requires your explicit consent at the start of each session. To opt out of session recordings, simply decline when prompted. To request removal of past session transcripts and recordings, please contact email info@randalljcoaching.com.

  • AI Optimization. You must explicitly opt in to allow your personal data to be used for optimizing AI models that power existing and new coaching tools for both clients and coaches. To protect your privacy, we take steps to de-identify and aggregate data we use to optimize AI models. If, after opting in, you change your mind, you may opt out by emailing info@randalljcoaching.com and no content created after you have opted out will be used for AI training.

  • Cookies. You may stop or restrict the placement of Technologies on your device or remove them by clicking on ‘Cookie Settings’ at the bottom of this page and adjusting your preferences as your browser or device permits. However, if you adjust your preferences, the Services may not work properly.

Please note that cookie-based opt-outs are not effective on mobile applications. However, you may opt out of certain tracking on mobile applications through your device settings. On iOS, go to Settings > Privacy & Security > Tracking. On Android, go to Settings > Privacy > Ads. Also, do not rely on using “DNT” (Do Not Track) or similar mechanisms transmitted by web browsers as we may not respond or honor them.

8. INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

All personal information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live.

9. HOW LONG DO WE RETAIN PERSONAL INFORMATION?

We store the personal information we collect as described in this Privacy Policy for as long as it is needed to fulfill the purpose(s) for which it was collected, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

To determine the appropriate retention period for personal information, we may consider applicable legal requirements, the amount, nature, and sensitivity of the personal information, certain risk factors, the purposes for which we process your personal information, and whether we can achieve those purposes through other means.

10. WHAT ABOUT CHILDREN’S PERSONAL INFORMATION?

The Services are not directed to children under 16, and we do not knowingly collect personal information from children. If you are a parent or guardian and believe your child has uploaded personal information to the Services in violation of applicable law, you may contact us as described in “Contact Us” below.

11. WHAT ABOUT HEALTH INFORMATION?

Coaching is not therapy or medical treatment, and coaches are not licensed therapists, psychologists, or other medical professionals. We are not a “Covered Entity” or a “Business Associate” as those terms are defined under the Health Insurance Portability and Accountability Act (“HIPAA”) and we will not ask for nor intentionally collect any “Protected Health Information.”

12. WHAT ABOUT THIRD-PARTY WEBSITES/APPLICATIONS?

The Services may contain links to other websites/applications and other websites/applications may reference or link to our Services. These third-party services are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen, or approve, and are not responsible for, the privacy practices or content of such other websites or applications. Providing personal information to third-party websites or applications is at your own risk.

Randall J Coaching does not facilitate healthcare services. Coaches will not offer any diagnosis, treatment, prescribing of medication, or any other clinical services. For mental health disorders or concerns, please seek help from a licensed psychotherapist or psychiatrist.
